Fired For being on route doing job and missing a meeting That was scheduled during my work hours of driving truck to pick up Refuse.
Then tried to get me to sign a do not compete document. Did not pay severance pay and tried to fight my unemployment.
They also worked me for 5 days after the date of the meeting . Then fired me.
I  worked for the refuse company in the area since 1982 over 30 years just to be fired for doing my job and not making a meeting because I was doing my job.

Dear Tony:
This letter, when signed by you, will constitute our Agreement regarding your separation from employment with KE Enterprises effective 07/19/2010.
Because of the subject of this letter, its tone is necessarily formal. However, on behalf of the Company, I want to express our appreciation for the contributions you have made during your association with KE. I also want to convey to you our best wishes for your future.
The Company agrees to provide you with the following separation/transition benefits:
  • Waiver of COBRA premiums from 8/1/2010 through 10/31/2010
  • No contest of unemployment claim
As an "At Will" employee, you acknowledge with your signature below that the Company has no legal obligation to provide you with these separation/transition benefits except as part of this Agreement. These benefits are unique to you and your circumstances, and are in lieu of any other separation or severance benefits to which you might otherwise be entitled under any policy, plan, or practice of the Company.

In consideration for these benefits, you release the Company, its officers, directors, employees, agents, and insurers from any claims you might have, whether known or unknown to you at this time, in connection with your association with, employment with or separation from the Company. This release includes any claims you might have had under applicable state, federal, or local law dealing with employment, contract, wage and hour, tort, or civil rights matters, including, but not limited to, applicable state civil rights or wage payment laws, Title VII of the Civil Rights Act of 1964, the Post-Civil War Rights Acts (42 USC §§1981-1988), the Civil Rights Act of 1991, the Age Discrimination in Employment Act, the Older Workers Benefit Protection Act, the Rehabilitation Act of 1973, the Americans with Disabilities Act, the Equal Pay Act, the Family and Medical Leave Act, the Uniformed Services Employment and Re employment Rights Act, the Worker Adjustment and Retraining Act, and any regulations under such laws. This release, however, does not affect any rights you might have for benefits under any applicable medical insurance, disability, workers' compensation, unemployment compensation, or retirement program.

You agree to hold confidential the terms of this Separation Agreement, except to the extent that disclosure of its terms to your spouse, accountant, attorney, and taxing authorities may be necessary for your financial or legal affairs as may be required by law. You further agree to not disclose, to any third party, the past and current practices, current or future goals, plans,
strategies and tactics, or what could be broadly regarded as the trade secrets of the company. This includes names of employees, customers, vendors and suppliers, pricing and financial techniques or details, and any other proprietary information not mentioned in this paragraph. You also agree that you will not disparage the company, its foinier and current managers or employees, goals,
practices or methods. You also agree to return, within seven (7) days, all company-owned equipment, keys, files, correspondence, directories, and all other materials related to your association with the Company

You acknowledge that this Separation Agreement, in conjunction with any previously signed Non-Compete Agreement, contains the entire agreement between you and the Company regarding the terms of your separation from employment. You further acknowledge that you have been given a reasonable period of time (21 days after the date of this letter) to consider this Agreement and discuss it with financial or legal counsel of your choice, and that you voluntarily sign it and agree to be bound by its terms. You understand that this Separation Agreement must be signed within 21 days after you receive it in order for you to be entitled to the benefits given under it. However, you may revoke the Separation Agreement by sending me a written statement to that effect within seven days after you have signed it. Unless you revoke it, the Separation Agreement will be effective as of seven days after you have signed it, and the Company will then provide you with the benefits stated in this Separation Agreement.

If you wish to enter into this Separation Agreement, please sign the enclosed copy where indicated and return the copy to me no later than 21 days after the date of this letter.
Again, I thank you for all you have done for during your association with KE, and I wish you every success in the future.

On Wednesday, July 14, 20110, you missed a mandatory team meeting without any reasonable explanation for missing it and you did not communicate with Budd or Scott regarding missing the meeting.
